These Terms of Service ("Terms") govern your access to and use of the UseBenchmark website, platform, software, and related services (collectively, the "Services") operated by Benchmark Construction Technology Corp, a Delaware corporation ("Company," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an entity, you represent that you have authority to bind that entity.

UseBenchmark provides software tools and analytical systems designed to support construction workflows, including but not limited to material take-offs, variance analysis, framing and component design support, plan intake and document processing, exportable reports and structured data outputs, and workflow and quality assurance tools.

You are responsible for maintaining the confidentiality of account credentials and all activities under your account. You agree not to reverse engineer, replicate, interfere with system integrity, or use the Services to develop a competing product.

Benchmark's Services are billed per plan or project. Any prices shown on our website, including outputs from the pricing calculator, are non-binding estimates provided for general guidance only and do not constitute an offer or a final quote. The binding price for any work is the written quote we provide for your specific plans. We assess each plan's project type, size, and complexity, and we reserve the right to apply complexity tiers or other adjustments in that quote; final pricing is confirmed there before work begins. Published pricing may change at any time. Fees are due as stated in your quote or invoice and are non-refundable except as required by law. We may suspend or withhold Services for non-payment.

All software, algorithms, systems, branding, documentation, and platform materials are the exclusive property of Benchmark Construction Technology Corp. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for internal business purposes.

The Services provide analytical outputs and estimations. Outputs are computational tools and not engineering certifications. You remain solely responsible for verifying quantities, compliance, and construction decisions.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.

You agree to indemnify and hold harmless Benchmark Construction Technology Corp from claims arising out of your use of the Services or violation of these Terms.

These Terms are governed by the laws of the State of Delaware.

Any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Delaware before a single arbitrator. You waive the right to a jury trial and agree that all claims must be brought individually, not as part of a class or collective action.

We may suspend or terminate access for breach, non-payment, or legal requirements. Termination does not relieve you of outstanding payment obligations.

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
